Probate of Will: In the Matter of the Last Will and Testament of Thomas Morris deceased
Continuance:

Be it remembered that heretofore to wit on the 23d day of December A D 1879 came J. B Rickey and produced to the Court. a Paper writing purporting to be the last will and Testament of Thomas S. Morris late of Scioto County deceased and asked to have the paper probated as the last will and Testament of the said Thomas S. Morris deceased upon consideration by the court. It is ordered that Phoebe Morris widow, Lyman T. Morris, Mary Sanders, William Morris and John S. Morris heirs at law and next of kin to the said Thomas S. Morris resident of the State of Ohio: be duly and legally notified of the production of said Paper Writing and the day of having paid matter and that said matter be set for having on the 8th day of January A D 1880 at 2 O clock P.M. at which time this cause is continued.
Continuance:
And afterwards on the 8th day of January A D 1880. pursuant to said Continuance and it appearing to the Court that the said Phoebe Morris (widow) Lyman T Morris, Mary Sanders have waive the issuing and service of notice and voluntarily retired? their appearance herein Court and that William Morris and John S. Morris have been duly and legally notified of said proceeding and evidence of the same filed herein Court; Thereupon this cause came to be further heard. Also came J. B. Rickey one of the attesting witnesses to said Paper Writing who being duly sworn according to law testified to the due and legal execution of the same and his testimony was reduced to writing and filed thereupon this cause is continued for the testimony of Sarah Elizabeth Fields the other attesting witness thereto.
Order:
And afterwards on the 14th day of January AD 1880 pursuant to the said Continuance came Sarah Elizabeth Fields the other attesting witness to said Paper Writing who being duly sworn according to Law also testified to the due and legal execution of the same and her testimony was reduced to writing and filed. and the Court being satisfied from said testimony that said Paper writing was duly and legally executed by the said Thomas S. Morris as and for his last will and Testament and that at the time of the execution thereof he the said Thomas S. Morris was of full age and of sound mind and memory and not under any restraint and that he the said Thomas S. Morris is now dead. It is ordered that the said last will and Testament Of the said Thomas S. Morris deceased of the said testimony and the order be recorded in the record of Wills for this County.
Election of Widow:
Thereupon came Phoebe Morris widow of the said Thomas S. Morris deceased who being duly advised of her rights in said will and at law accepted the provisions made for her in said will and elected to take thereunder
Will:
In the name of the Benevolent Father of all. I Thomas S. Morris of Jefferson Township. Scioto County. Ohio. Do make and publish this my last Will and Testament. First I give and bequeath to my beloved wife Phoebe Morris so long as she may live all the land I now own to wit, the home farm being apart of the south-west quarter of section Twenty Seven (27) Township three (3) of Range twenty One containing One hundred and twenty six acres more or less, and One other lot Bounded as follows, The south east quarter of the south-east quarter of Section twenty seven 27. Township Three (3) of range twenty One (21) containing forty acres more or less with all the Personal Property that I may own at my death and [at?] paid Phoebe Morrises death to go to the four sons of mine as follows, Second I give and bequeath to my son Lyman T. Morris a piece of Land described as follows..out of the farm I now live on commencing at the South-west corner running 181 rods east thence north 28 rods to a Stake thence west 181 rods to a Stake thence south 28 rods to the place of Beginning containing twenty eight acres more or less: Also the east half of the South-East qr of the south-east qr of section twenty seven in Township three and range twenty one containing twenty acres more or less. Third I give and bequeath to my son William Morris the Second tract or parcel commencing at a stake at the northwest corner of the first described tract and running east 181 rods thence north 28 rods thence west 181 rods to a stake in the rod and thence south to the place of beginning, 28 rods, containing twenty eight acres more or less, also the west half of the south-east qr of the south-east qr of Section twenty seven in Township three and range twenty One containing twenty acres more or less. Fourth= I give and bequeath to my son John S. Morris the third tract or parcel commencing at a stake at the north west corner of the Second described tract and running east 181 rods to stake thence north 28 rods to a stake thence west 181 rods to a Stake near the rod thence south to the place of beginning or 28 rods. Containing twenty eight acres more or less Fifth, I give and bequeath to my son Theophilas W. Morris the fourth tract or piece commencing at a stake at the north west corner of the third described tract and running east 181 rods to stake thence north 28 rods to a stake thence west 181 rods to a stake or rod thence south - 28 rods or to place of beginning containing twenty eight acres more or less Sixth. In behalf of my four daughters Mary Sanders Eunice Sloan Emily Fields Eliphil Grimshaw each to have one hundred and fifty Dollars as follows in part of the consideration of Land to my son Lyman T Morris he is to pay to each of my above named Daughters Thirty seven dollars and fifty cents $37.50 within two years after the death of my wife Phoebe Morris. Seventh my son William Morris is to pay to each of the above named daughters respectively thirty seven dollars and fifty cents $37.50 within two years after the death of my wife Phoebe Morris. Eighth my son John S. Morris is to pay to each of the above named daughters respectively thirty seven dollars and fifty cents $37.50 within two years after the death of my wife, Phoebe Morris. Ninth, my son Theophilus W. Morris is to pay to each of the above named daughters respectively thirty seven dollar and fifty cents $37.50 within two years after the death of my wife Phoebe Morris. Tenth their being a Mortgage on the foregoing described lands in form of Abner Fields about $230.00 and a debt by note of hand given to Adam Burkell for near $150.00 in all near $380.00 or whatever it may be when paid to be paid by each of the above named sons equally and each of my four daughters above named is to allow nine dollars and twenty seven cents to be retained by each son from the said thirty seven dollars and fifty cents as their share of the above stated Indebtedness In testimony whereof I declare this my last will and Testament and sign it as such in presence of these witnesses and signing as attesting witnesses in my presence This 28th day of August AD 1879 T.S.Morris, Attesting Witnesses J.B.Rickey Sarah Elizabeth Fields

The State of Ohio Scioto County SS Probate Court JB Rickey Of lawful age being first duly sworn deposeth and said that he saw the said Thomas S. Morris of said County of Scioto execute the paper executing hereto attached purporting to be his last Will and Testament and heard the said Thomas S. Morris acknowledged the source to be his last Will and Testament Affiant further say that he signed his name as attesting witness to the said paper writing in the presence and at the request of the said Thomas S. Morris and in the presence of Sarah E. Fields the other attesting witness to the said last Will and Testament and affiant further say that at the time of the execution of said last Will and Testament by the said Thomas S. Morris he the said Thomas S. Morris was of full age and of sound mind and memory and not under any restraint and that said Thomas S. Morris is now deceased J. B. Rickey sworn to and subscribed in open Court before me this 8th day of January AD 1880 H C Turley, Probate Judge. By Thomas G. Calvert Deputy Clerk.
